I. OVERVIEW

Naypex is a multivendor marketplace that connects independent vendors selling physical products with buyers. When you use our Site — whether as a buyer, vendor, or visitor — we collect certain information to operate the marketplace, process transactions, and improve your experience.

We use cookies and other technologies to collect information about your browsing activity. We and our advertising partners may collect information about your online activities over time and across different websites to deliver relevant advertising. You can opt out of interest-based advertising, but opting out does not mean you will no longer receive advertising — it means the ads you see may be less relevant to your preferences.

II. CATEGORIES OF PERSONAL INFORMATION WE COLLECT ABOUT YOU

Depending on your interaction with us, we may collect the following categories of personal information directly from you, from third parties, and automatically through your use of our Site.

Information We Collect From Buyers:

  • Identifiers, such as your name, email address, shipping address, billing address, phone number, IP address, and unique online identifiers.
  • Payment information, such as credit card number, debit card number, or other payment card information (processed securely through our third-party payment processors; we do not store full payment card details).
  • Commercial information, such as records of products purchased, order history, and wishlist items.
  • Internet or other electronic network activity, such as your browser type and operating system, pages visited, links clicked, search queries, products viewed, and the length of time you visit our Site.
  • Geolocation data, such as approximate location based on your IP address.

Information We Collect From Vendors:

  • Identifiers, such as your legal name, business name, email address, physical address, phone number, and IP address.
  • Tax identification information, such as your Employer Identification Number (EIN) or Social Security Number (SSN), as required for IRS Form 1099-K reporting.
  • Payment and financial information, such as your PayPal email address or bank account details for commission disbursements and withdrawals.
  • Identity verification documents, as required during the vendor approval and verification process.
  • Store content, such as store name, description, banner images, profile pictures, product listings, and product images.
  • Commercial information, such as sales records, commission history, withdrawal history, and order fulfillment data.

Information Collected Automatically From All Users:

  • Device and browser information, including IP address, browser type and version, operating system, device type, and screen resolution.
  • Usage information, including pages visited, links clicked, search queries, referring URLs, and time spent on pages.
  • Cookie and tracking data, as described in Section VI.

Information From Third Parties:

  • Payment processors (such as PayPal and Stripe) may share transaction information with us to facilitate payments and prevent fraud.
  • Identity verification services may share verification results for vendor approval.
  • Social media platforms may share profile information if you choose to link your accounts.

III. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  • To operate our marketplace. Processing transactions between buyers and vendors, facilitating order fulfillment, calculating and disbursing vendor commissions, managing vendor stores, and providing customer support.
  • To create and maintain accounts. Authenticating your identity, managing your account settings, and personalizing your experience.
  • To process payments. Processing purchases, splitting payments between Naypex and vendors based on our commission structure, facilitating vendor withdrawals via PayPal or bank transfer, issuing refunds, and detecting fraudulent transactions.
  • To facilitate order fulfillment. Sharing buyer shipping information with vendors so they can package and ship products. Vendors receive buyer name, shipping address, email, and phone number solely for order fulfillment purposes.
  • To communicate with you. Sending order confirmations, shipping updates, withdrawal notifications, vendor approval decisions, platform announcements, policy updates, and responding to inquiries.
  • To improve our services. Analyzing usage patterns, testing new features, monitoring platform performance, and improving the user experience.
  • To ensure safety and security. Detecting and preventing fraud, abuse, and unauthorized access, enforcing our Terms of Use and Vendor Terms and Conditions, verifying vendor identities, and protecting the rights and safety of our users.
  • To comply with legal obligations. Meeting tax reporting requirements (including IRS Form 1099-K for vendors meeting applicable federal thresholds), responding to legal requests, and complying with applicable laws and regulations.
  • For marketing and promotional purposes. With your consent, we may send promotional emails about new features, products, or marketplace updates. You may opt out at any time (see Section VII).
  • To deidentify data. We may anonymize your data so that you cannot reasonably be re-identified, and we may use such de-identified data for any purpose permitted under applicable law.

IV. HOW WE SHARE AND DISCLOSE YOUR INFORMATION

We do not sell your personal information except as described in connection with interest-based advertising below. We share your information in the following circumstances:

  • Between Buyers and Vendors. When a buyer places an order, we share the buyer’s name, shipping address, email address, and phone number with the vendor to fulfill the order. This is essential for the operation of our marketplace. Vendors are contractually required to use this information solely for order fulfillment and related customer service (see Section V).
  • Service Providers. We share information with trusted third-party service providers who assist us in operating our platform, including payment processors (PayPal, Stripe), hosting providers, email service providers, analytics providers (such as Google Analytics), identity verification services, and customer support tools. These providers are contractually obligated to use your information only for the purposes we specify.
  • Legal Compliance. We may disclose your information to comply with applicable law, respond to subpoenas, court orders, or government requests, protect the safety, rights, or property of Naypex or our users, or detect, prevent, or address fraud or security issues.
  • Business Transfers. In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
  • Interest-Based Advertising. We may share information collected through cookies and similar technologies with third-party advertising partners, including social media platforms, analytics providers, and advertising service providers, for the purpose of delivering targeted advertisements. Under some state laws, this may be considered a “sale” or “sharing” of personal information. You may opt out as described in Section XII.
  • Aggregate and De-identified Information. We may disclose aggregate, anonymized, or de-identified information for any purpose permitted under applicable law.
  • With Your Consent. We may share your information with third parties when you have given us explicit consent.

V. VENDOR RESPONSIBILITIES REGARDING BUYER DATA

Naypex is a multivendor marketplace. When buyers place orders, their personal information is shared with the independent vendor fulfilling the order. This section explains how vendor data handling works:

  • Independent Controllers. Each vendor on Naypex is an independent data controller and is separately responsible for the buyer personal information they receive through our platform. Naypex is not responsible for the privacy practices of individual vendors.
  • Limited Use. Vendors are contractually required under our Vendor Terms and Conditions to use buyer information (name, shipping address, email, phone number) solely for order fulfillment, shipping, and related customer service. Vendors must not use buyer information for marketing, promotional purposes, or any other purpose without the buyer’s explicit consent.
  • Data Protection. Vendors must protect buyer information from unauthorized access, disclosure, or misuse, and must comply with all applicable data protection and privacy laws.
  • Data Deletion. Vendors must delete or securely dispose of buyer information when it is no longer needed for order fulfillment, unless retention is required by law.

If you believe a vendor has misused your personal information, please contact us at contact@naypex.com.

VI. OUR USE OF COOKIES AND RELATED TECHNOLOGIES

We and our third-party partners use cookies and similar tracking technologies to collect information about your use of our Site.

  • Cookies. We use both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device until deleted). You can manage cookies through your browser settings, but disabling cookies may limit your ability to use some features.
  • Clear GIFs and Pixel Tags. We use these technologies to track Site usage, manage content, and compile statistics. They may also be used in emails to track open rates and click-through rates.

  • Interest-Based Advertising. You can opt out of interest-based advertising at https://optout.aboutads.info or https://optout.networkadvertising.org.
  • Do Not Track (DNT). There is no industry consensus on how to respond to DNT signals. Like many websites, we do not currently alter our practices when we receive a DNT signal. For information about Global Privacy Control, visit https://globalprivacycontrol.org.

VII. MARKETING COMMUNICATIONS

We may send periodic promotional emails to you. You may opt out of promotional emails by following the “unsubscribe” link in any marketing email or by updating your notification preferences in your account settings. Please note that it may take up to 10 business days to process opt-out requests. Even if you opt out of marketing emails, we may still send transactional emails about your account, orders, or vendor activity.

VIII. SECURITY OF YOUR INFORMATION

We implement physical, technical, and organizational security measures to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit (SSL/TLS), secure storage of payment information through PCI-compliant payment processors, access controls limiting employee access on a need-to-know basis, and regular security monitoring.

Despite our efforts, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security, and you use our platform at your own risk.

IX. THIRD-PARTY LINKS

Our Site may contain links to third-party websites, including vendor websites and external services. This Privacy Policy does not apply to those third-party websites. We encourage you to review the privacy policies of any third-party sites you visit.

We do not knowingly “sell” or “share” the personal information of children under the age of 16.

XI. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, maintain your account, and comply with our legal obligations. Specifically:

  • Account information is retained for as long as your account is active, plus a reasonable period after closure.
  • Transaction records are retained for a minimum of 7 years to comply with tax reporting and financial record-keeping requirements.
  • Communications are retained as needed for customer support and dispute resolution.
  • Usage data is typically retained in aggregated or anonymized form for analytics purposes.
